Digital Products - Usage and Returns Policy
1. General
This page set out the terms and conditions between you, the customer, and DIY Visa (“us”, “we”), governing the use of our website and our downloadable digital patterns including the content therein (the “products”). Your use of our website, and purchase, download and use of our products, constitutes your full acceptance of these terms and conditions. If you do not agree with these terms and conditions, you should not use our website or purchase, download or use any of our products.
These terms and conditions constitute the entire agreement and understanding between you and us for the supply of downloadable digital products and shall supersede any prior agreements whether made in writing, orally, implied or otherwise. These terms and conditions, your acceptance thereof, and our relationship with you shall be governed by and construed in accordance with English law and both us and you irrevocably submit to the exclusive jurisdiction of the English courts over any claim, dispute or matter arising under or in connection with these terms and conditions or our relationship with you.

2. Purchase Terms of Agreement

The purchase of digital products, including PDF downloads and online material is subject to the following terms and conditions. Consumers are advised to review carefully before making any purchase.

3. License and Use
Your purchase of one of our products constitutes our granting to you of a non-exclusive, non-sublicensable, non-transferable license to download and access that product for the purpose of your own personal use, your own storage, retention and reference (the “purpose”). You agree that under no circumstances shall you use, or permit to be used, any product other than for the aforesaid purpose. For the avoidance of doubt, you shall not copy, re-sell, sublicense, rent out, share or otherwise distribute any of our products, whether modified or not, to any third party. You agree not to use any of our products in a way that might be detrimental to us or damage our reputation.

4. Intellectual Property
The products, whether modified or not, and all intellectual property and copyright contained therein, are and shall, at all times remain our sole and exclusive property. You agree that under no circumstances, whether the product has been modified or not, shall you have or attempt to claim ownership of any intellectual property rights or copyright in the product.​

5. Warranties and Liabilities

We make every effort to ensure that our products are accurate, authoritative and fit for the use of our customers. However, we take no responsibility whatsoever for the suitability of the product, and we provide no warranties as to the function or use of the product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for particular purpose.
6. Payment

All transactions for the purchase of intangible products, pdf downloads, resource material, and online content are made through payment gateways such as PayPal or Stripe that use SSL encryption. These payment gateways are safe and secure for using all types of credit cards and debit cards in different countries and your details are not stored during this process.

You agree that any payments made by you for any of our products are final and may not be charged back by either us or your payment provider. We reserve the right to alter any of our prices from time to time without prior notice.

7. RefundS Policy
​
Digital downloads are given their own unique category under the Consumer Contracts Regulations and are therefore not services or goods.

If you want to download something within 14 days of buying it, you will have to give your consent to waive the 14-day cooling-off period. If you don’t give your consent, the 14-day cooling-off period still applies, but you won’t be able to download your digital content until this period has ended. If you do not give consent to waive the 14-day cooling-off period, you must inform us of this prior to your purchase and we will ensure to send your digital products 14 days after the cooling-off period. This is to prevent you from changing your mind after you have downloaded the content.

Once a product has been downloaded by you, no right of cancellation or refund exists under the Consumer Contracts Regulations due to the electronic nature of our products. Since your purchase is a digital product, it is deemed “used” after download or opening, and all purchases made on www.diy-visa.co.uk are non-refundable or exchangeable. Any refunds shall be at our sole and absolute discretion.

DIY Visa reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product or service offerings without prior notice.

8. Delivery of Goods and Services
​
Once you have completed your purchase of the digital product, you should instantly receive a link in the email inbox specified by you at checkout. If you do not receive the digital product link upon purchasing, please check your junk folder or contact support@diy-visa.co.uk with proof of purchase and your order number and we will ensure your product is delivered as soon as possible.
